Decision

Objective:

To guide immigrants through the final step of the immigration process, where they await the decision from the U.S. Citizenship and Immigration Services (USCIS) on whether their case is approved or denied.

Step 1: Understanding the Decision Process

  • Purpose: To gain an understanding of what happens after your interview and during the decision-making process.
  • Actions:
    • Your Legal Assistant will explain that after your interview, USCIS will review your entire case, including all submitted documents, your biometrics, and the interview itself.
    • Understand that this step can take time, and the duration may vary depending on the type of case and the workload of the USCIS office handling your case.
    • Be aware that in some cases, USCIS may request additional information before making a final decision.

Step 2: Monitoring Your Case Status

  • Purpose: To stay informed about the progress of your case while waiting for a decision.
  • Actions:
    • Regularly check your case status online using the USCIS case status tool. Your Legal Assistant will provide you with the necessary information to do this.
    • Your Legal Assistant will also monitor the status of your case and keep you updated on any developments.
    • Be aware that it is normal for this stage to take some time, and frequent status checks may not always show immediate changes.

Step 3: Practicing Patience

  • Purpose: To manage expectations and maintain patience during the waiting period.
  • Actions:
    • Understand that the decision-making process can be lengthy, especially for more complex cases.
    • Use this time to prepare for any outcome, whether it’s planning for the next steps if approved or considering alternative options if denied.
    • Stay engaged in regular life activities and avoid letting the wait dominate your thoughts.

Step 4: Receiving the Decision Notice

  • Purpose: To receive and understand the official decision on your case from USCIS.
  • Actions:
    • USCIS will send an official notice by mail with their decision on your case. This notice will indicate whether your case has been approved, denied, or if further action is required.
    • Your Legal Assistant will notify you immediately once the decision is received and provide you with a copy of the notice.
    • Carefully read the decision notice with your attorney to fully understand its content and implications.

Step 5: Responding to the Decision

  • Purpose: To take appropriate action based on the USCIS decision.
  • Actions:
    • If Approved:
      • Celebrate the approval and discuss the next steps with your attorney, such as receiving your visa, green card, or other immigration benefits.
      • Follow any instructions provided by USCIS for finalizing your immigration status.
    • If Denied:
      • Discuss the reasons for the denial with your Legal Assistant to fully understand the decision.
      • Explore your options for appeal, reapplication, or other legal remedies.
      • Work with your Legal Assistant to develop a plan for addressing the issues that led to the denial.

Step 6: Preparing for Any Additional Steps

  • Purpose: To be ready for any further actions that may be required based on the decision.
  • Actions:
    • If USCIS requests additional information or documentation before making a final decision, respond promptly with the help of your Legal Assistant.
    • If your case requires an appeal or motion to reopen, your Legal Assistant will guide you through the process.
    • Keep all related documents organized and readily accessible for any future requirements.

Step 7: Securely Store the Decision Documents

  • Purpose: To maintain a record of the decision and any related documents for future reference.
  • Actions:
    • Store the decision notice, along with any related documents, in a secure and accessible location.
    • Make digital copies of these documents for backup, ensuring they are securely stored.
    • These documents may be needed for future immigration processes or legal matters, so keep them well-organized.

Step 8: Moving Forward

  • Purpose: To proceed with your life and immigration journey based on the decision.
  • Actions:
    • If your case is approved, begin integrating your new immigration status into your life, following any remaining legal steps.
    • If your case is denied, work with your Legal Assistant to consider your options and decide on the best course of action.
    • Stay in contact with your Legal Assistant for ongoing support and guidance as you move forward with your immigration process.
